A judge ruled Bryan Kohberger, who is autistic, according to his lawyers, could still be put to death if he is convicted of killing four University of Idaho students in 2022.

The first ruling was that prosecutors can pursue the death penalty if Kohberger is convicted, despite his recent autism diagnosis. Kohberger’s defense team argued that executing someone with autism would constitute cruel and unusual punishment under the eighth amendment.
